Assembly Bill 430 allows the Division of Child and Family Services to establish a family home visiting system by governmental entities to visit homes of children during early childhood. This bill represents a violation of privacy, and 4th amendment rights against unlawful search and seizure.
These visits will look for, collect, and report on "Information concerning outcomes relating to prenatal, maternal, infant and child health, occurrences of child abuse and neglect, family economic security, childhood development and school readiness." (lines 42 - 45 of AB430)
This bill assumes parents are unable to care for their own children and establishes no probable cause for the visits. Visits will be based off of "Any...risk factor identified by the Division." (line 29 of AB430) This gives the State unprecedented license to monitor a family with no due process and no evidence of a crime or neglect against a child.
The caring and raising a child is the business of the family and their health care professionals. Assessment and request for additional resources should come from the family and health care professional, not from the State.
The hearing for this bill is scheduled for Wednesday, April 10 12:30PM with the Assembly Committee on Health and Human Services. It will be videoconferenced to Room 4406 of the Grant Sawyer State Office Building, 555 E. Washington Ave., Las Vegas, NV.
