6 Key Opt-out Rights for Parents.

Back-to-School Checklist: Opt-Out Options School starts in just one week, and as you're checking off supply lists and setting alarm clocks, there’s one more thing we want to make sure you know: You still have the power to protect your child. There are six key areas in your child’s education where you have the legal right to opt out, and many parents don’t realize it! Here’s a quick overview: 6 Things You Can Opt Out Of as a Parent:  Sex Education In Nevada, sex ed is opt-in. That means your child cannot be enrolled without your written permission. You also have the right to review the curriculum first. Content That Conflicts with Your Religious Beliefs If any instructional material conflicts with your family’s values, you can request an alternative assignment. Federal law protects this right — just be sure to submit your request in writing. Compulsory Public School While school attendance is mandatory, public school is not. You have the legal right to homeschool or choose private school, so long as state guidelines are followed, including submitting an Intent to Homeschool form. Vaccinations Nevada allows exemptions for both medical and religious reasons. You must file an exemption form each year if you’re opting out. Standardized Testing Most standardized tests are not required for promotion or graduation. You can request that your child not participate. Surveys on Political, Sexual, or Personal Beliefs Schools must notify you in advance and give you the option to opt your child out of any survey that touches on these topics. A Win for Parents—And a Reminder of Why We Fight Dear Supporter, On Friday, June 27, the U.S. Supreme Court issued a landmark 6-3 decision in Mahmoud v. Taylor, affirming that parents have a constitutional right to opt their children out of public school materials that conflict with their sincerely held beliefs. This is a major win for parental rights nationwide—and a powerful affirmation of what we’ve fought to protect here in Nevada for the past decade. At Power2Parent, we have always believed that parents—not the government—are the primary decision-makers in their child’s education. Since our founding, led the charge to ensure parents have the right to opt in to sex education, not be forced to opt out. Year after year, we stood against legislative attempts to erode this right, including bills that would have stripped parents of their ability to know what their children are being taught about human sexuality, gender identity, and family values. This year, we faced one of the most aggressive challenges to parental rights yet: AB205, a bill that would have erased Nevada’s opt-in law and automatically enrolled children in sex education without parental consent. We mobilized, testified, and fought every step of the way—and we won. Thanks in part to your investment, Governor Lombardo vetoed AB205, and parental consent in Nevada remains protected. This victory, combined with the Supreme Court’s decision in Mahmoud v. Taylor, reinforces what we’ve said all along: Parents have the right to raise their children according to their values—without government interference. We are celebrating this moment with you because it's a shared victory—made possible by years of grassroots advocacy, bold leadership, and your generous support. But we’re not done yet. This ruling is a reminder of what is possible when we stand united—and a motivator to keep pressing forward. As we head into another school year and prepare for the next legislative session, we will continue to: Monitor and oppose legislation that undermines parental rights Equip families to advocate for their values in schools and communities Expand programs that give parents real choices in education Thank you for standing with us.
